Age Discrimination Situation: Too Old For Italian Restaurant

Age discrimination is a serious issue in employment law. Age discrimination is the discriminating against individuals or groups based on their age.

Take the following hypothetical example for instance:

A woman named Jane is a hostess at an Italian restaurant. Jane has been working there since she was 33 years old; she is now 62 years old. Jane is known as an attentive and responsible employee and has received good reviews from all of her managers at the restaurant. One day, the owner of the restaurant fires two of the older waitresses, Mindy and Jessica. Mindy and Jessica are distraught and get coffee with Jane after work. Mindy tells Jane how the owner fired them without any reason and only told them that “although it has been a pleasure to work together, the restaurant is currently undergoing aesthetic changes.” The following Monday while Jane is at work, she notices that two younger female employees have replaced Mindy and Jessica as waitresses. Slowly, Jane notices that many of the older employees are being let go and replaced with younger waitresses and waiters. A few months after Mindy and Jessica have been fired, Jane is called into the restaurant owner’s office. He tells Jane that she may have “noticed a few changes happening at the restaurant” and that he unfortunately has to let her go. As a result, Jane becomes depressed.
